1. Acceptance of Terms

By accessing and using Ningal App Generator ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Ningal App Generator is an AI-powered platform that generates desktop applications based on natural language descriptions. We provide compiled executables for Windows and Linux platforms.

The Service is provided by Ningal Software, a sole trader business with tax ID (NIF) 40306092H, Avda. Tarragona 10, 43881 Cunit (Tarragona), Spain. Email: info@ningal.com.

3. User Accounts

You must create an account to use our Service. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Providing accurate and complete registration information

4. Acceptable Use

You agree not to use the Service to:

Generate malicious software, viruses, or harmful code
Create applications that violate any laws or regulations
Infringe on intellectual property rights of others
Generate illegal, harmful, or offensive content
Create cheats, aimbots, recoil scripts or other tools that give an unfair advantage in third-party games, or that bypass anti-cheat, DRM, licensing or other technical protection measures
Create software that monitors or controls other people's devices, accounts or data without their authorization (such as spyware, keyloggers or credential stealers)
Create applications intended to secretly or unlawfully surveil, track or repress individuals
Create multiple accounts or use automated means to get around plan limits
Attempt to reverse engineer or exploit the Service

You confirm that you are not located in, or a resident or national of, any country or region subject to comprehensive sanctions, and that you are not on any sanctions or restricted-party list. You will not use the Service where prohibited by applicable export-control or sanctions law.

We may refuse to generate or modify an application that we believe breaks these terms.

5. Subscription and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Subscription fees are non-refundable except as described in our Refund Policy. We reserve the right to modify pricing with 30 days notice.

6. Intellectual Property and Your Applications

Applications generated using our Service are owned by you. How we handle your prompts and application code is described in our Privacy Policy. The Ningal platform, including all code, algorithms, and designs, remains our exclusive property.

Ningal App Generator builds applications from the instructions you give it, applying automated checks. It does not manually review, endorse or monitor your applications. You decide what to ask for and how to use and distribute the result, and you are responsible for it (its content, its behaviour, its legality and its distribution), including complying with the terms of the software and services it interacts with.

If an application handles personal data (for example about employees, customers or visitors, and especially biometric data such as face images or fingerprints), you decide how and why it is used and you are responsible for complying with data protection law, such as the GDPR: having a lawful basis, informing the people concerned, and keeping the data secure. Applications run on your own computers, and Ningal does not receive the data they handle.

Applications are written by an AI model from your description and are not reviewed by a person. They can contain errors: they may delete or change files, send data to the services they use, or give wrong results. Before you rely on an application or give it to others, test it with a copy of your data and keep backups of any data it uses. Do not use applications where an error could cause serious harm, such as health, safety, legal or financial decisions, or critical systems. If you give an application to others, you are responsible to them for it.

7. Limitation of Liability and Indemnity

The Service and the applications it generates are provided "as is", without warranties of any kind, including that an application will work without errors or be fit for a particular purpose. We are not liable for any indirect, incidental, special or consequential damages, or for loss of data, arising from your use of the Service or of the applications it generates. To the extent permitted by law, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as liability for wilful misconduct or gross negligence, or the rights that consumer law gives you.

You agree to indemnify and hold harmless Ningal App Generator against any claim, loss or cost (including reasonable legal fees) brought by a third party and arising from an application you generate or from how you use or distribute it.

8. Termination

We may terminate or suspend your account at any time for violation of these terms. You may cancel your account at any time through your account settings.

If we receive a report of misuse of an application, we may suspend the account, delete its applications and downloads, and cooperate with the competent authorities. To report misuse, write to abuse@ningal.com.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service.

10. Governing Law

These terms are governed by Spanish law. If you are a consumer, this does not deprive you of the protection of the mandatory laws of your country of residence, nor of your right to bring proceedings before its courts.
